Investment protection based on international treaties has been available to investors for some time now. However, there is a gradual change to this mechanism due to steps taken by the EU Commission, including to create an Investment Court. In the case of BITs, the issue evolved with the Romanian Micula case, followed up by infringement proceedings against Austria, the Netherlands, Romania, Slovakia and Sweden and today with the AG Wathelet opinion on these issues. What are the issues at stake and the current developments?
